Terms of Service

These Terms are an agreement between you and Model2Photo (“we”, “us”), the operator of Model2Photo (the “Service”). By creating an account or using the Service you accept them. If you do not accept them, do not create an account.

If you are using the Service for an organisation, you confirm you are authorised to accept these Terms on its behalf.

Model2Photo is beta software. Features may change, break, or be removed without notice. Some capabilities are restricted or unavailable during the beta, and availability is not guaranteed. Do not rely on the Service for anything you cannot afford to lose or redo.

We may impose or change usage limits, including limits on free usage, at any time.

You must provide accurate registration details, keep your credentials secure, and are responsible for everything done through your account. You must be old enough to form a binding contract where you live. Do not create multiple accounts to obtain additional free usage.

You keep all rights to the photos, 3D models, text and images you supply (“Your Content”) and to the composites and exports you produce with them. We claim no ownership of them.

You confirm that you own or are licensed to use Your Content, and that using it with the Service does not infringe anyone’s copyright, trade mark, privacy, or other rights. This matters for 3D models in particular: many are licensed for personal use only, or forbid commercial or promotional use.

You grant us only the limited permission needed to operate the Service for you: to store, process and transmit Your Content for the purposes described in section 5. That permission ends when you stop using the Service, except where we must retain something by law.

3D model files are not uploaded. A model you add is read and rendered in your browser and cached in that browser’s local storage so it can be reattached later. The file itself is never sent to our servers. We record only a content fingerprint (a SHA-256 hash), the filename and the file size, and only to operate the usage allowance described in section 6.

Because the file stays in your browser, clearing your browser storage, switching browser, or using another device means the Service can no longer reattach that model and will ask you to select it again.

Photos stay on your device until you run the AI pass. Placing, positioning, capturing and downloading all happen locally. If and when you run the AI photorealistic pass, your photo and the composite image are transmitted to our servers and forwarded to our AI provider (currently Google) for processing. Do not run the AI pass on images containing anything you are not willing to share with a third-party provider — personal, confidential, or otherwise sensitive material included.

Our AI provider processes that content under its own terms and privacy policy. We do not control how a third-party model provider handles submitted content.

During the beta the Service is free and nothing is for sale. There is no limit on the number of 3D models you place, photo uploads are not metered, and capturing and downloading your composites is unrestricted. There are no credits to buy and no payment is taken.

The AI photorealistic pass does not run inside the app during the beta. You can still produce it yourself: the Service gives you the exact prompt and both images to run in your own Google Gemini session, on your own account and at your own cost with Google. Nothing in that route involves a payment to us.

Section 5 still applies to anything you choose to send: if a future release runs the AI pass in-app, your photo and composite are transmitted to our AI provider at that point, and not before.

This section describes how paid features will work when they are introduced. It has no effect while section 6 applies, and we will tell you before anything here starts to.

After the beta, some features are expected to require credits — in particular running the AI pass inside the app, which costs us money per run. Free usage may become limited. Prices will be shown before any purchase, and payments will be handled by our payment provider; we will not receive or store your card details.

A generation credit will be consumed when a generation is attempted, not when it succeeds. Running the AI pass incurs a cost to us the moment the request reaches the provider, whether or not a result comes back, comes back usable, or is one you like. A failed, refused or disappointing generation will still consume the credit. We think that is the fair arrangement, because the alternative is repeated retries at our expense — but you should understand it before you ever buy anything.

Credits, when introduced, are a limited licence to use a feature of the Service. They are not money, have no cash value, are not a deposit or stored value, cannot be transferred between accounts, and cannot be redeemed for cash. Purchases will be final and non-refundable except where a refund is required by law. If you ever believe you were charged in error, or paid and did not receive what you paid for, contact us at support@model2photo.com and we will investigate.

We may apply rate limits to protect the Service, including a cap on generations per day, independently of any credits held.

This section is the one worth reading twice.

It is a visualisation tool, not a measurement. Model2Photo estimates perspective and scale from values you supply — an eye level you trace, a camera height you type, a real-world object height. Those inputs are estimates, and the output is an approximation built on them. Accuracy degrades as the camera tilts away from level, and the Service warns you when it does.

Do not use output as evidence that something fits, complies, or is safe. It is not a survey, a site measurement, a space-planning certification, an engineering drawing, or a code-compliance check. Do not rely on it for structural, dimensional, safety, accessibility, or regulatory decisions. Confirm real-world dimensions by measuring the real world.

AI output is generated, not photographed. The AI pass relights and re-renders your composite. It may alter, add, remove, or invent detail, including details you did not intend and would not accept. It does not depict a real scene and must not be presented as an unaltered photograph or as a factual record of a place, a product, or an event.

If you show output to a customer, that is on you. Where an image is used to promote or sell a product or a space, you are responsible for ensuring it is not misleading and complies with applicable advertising, consumer-protection and disclosure rules — including any obligation to disclose that an image is AI-generated or digitally altered.

You must not use the Service to:

• upload content you do not have the rights to use;
• create images intended to deceive — including passing off generated images as genuine photographs of real places, products, or events;
• depict real, identifiable people without their consent;
• produce unlawful, harassing, hateful, or sexually exploitative material;
• circumvent, disable or interfere with usage limits, metering, authentication, or billing, or attempt to obtain paid features without paying;
• scrape, resell, or run the Service as a bulk or automated image pipeline for third parties, or otherwise use it in a way designed to shift our provider costs onto us;
• reverse engineer or attempt to extract our prompts, keys or provider credentials;
• interfere with the Service’s operation or security.

We may suspend or terminate accounts that breach this section, and may do so without notice where the breach is ongoing or causing harm or cost.

We do not guarantee uninterrupted availability. The Service depends on third parties, including a hosting platform, a payment provider, and an AI model provider, and may be degraded or unavailable when they are. We may change, suspend, or discontinue the Service or any feature at any time. Where we discontinue it entirely, we will make a reasonable effort to give notice so you can retrieve your work.

Your composites and exports are files you download. We do not undertake to store them for you, and you should keep your own copies of anything you want to keep.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, dimensional correctness, realism, or suitability of any output for any purpose.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, lost business, lost data, or costs of substitute goods or services, arising out of or relating to the Service.

Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or fifty US dollars.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

You agree to indemnify us against claims, damages and reasonable costs arising from Your Content, from your use of output produced with the Service, or from your breach of these Terms — including claims that Your Content or an image you published infringed someone’s rights or misled someone.

You may stop using the Service and request deletion of your account at any time by contacting support@model2photo.com. We may suspend or terminate your account for breach of these Terms, or where required by law.

Unused credits are forfeited on termination for breach. If we discontinue the Service entirely, we will refund unused credits purchased within the preceding twelve months on request.

We may update these Terms. Where a change is material we will give notice in the app or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and contact us about any unused credits.

These Terms are governed by the laws of North Carolina, USA, without regard to conflict of law rules, and the courts of North Carolina, USA have exclusive jurisdiction, except where mandatory local consumer law gives you the right to bring proceedings elsewhere.
